Long Island Man Arrested For Defending Home With AK-47

Says Many Gang Members Were Coming After His Family

UNIONDALE, N.Y. (CBS 2) — He was arrested for protecting his property and family.

But it’s how the Long Island man did it that police say crossed the line.

He got an AK-47 assault rifle, pulled the trigger and he ended up in jail, reports CBS 2’s Pablo Guzman.

George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home.

“I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said.

Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.

“He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said.

Grier was later arrested. John Lewis is Grier’s attorney.

“What he’s initially charged with – A D felony reckless endangerment — requires a depraved indifference to human life, creating a risk that someone’s going to die. Shooting into a lawn doesn’t create a risk of anybody dying,” Lewis said.

Grier said he knew Nassau County Police employ the hi-tech “ShotSpotter” technology in his area and that the shooting would bring police in minutes. Cops told Guzman he was very cooperative.

Grier also said he was afraid the gang outside his house was the dreaded MS-13. And Nassau County Police Lt. Andrew Mulraine, head of the gang unit, said MS-13 has 2,000 members in the county.

“They’re probably the most organized. They almost have a military hierarchy within the gang, so they are the most organized gang we encounter on a daily basis,” Mulraine said.

You may think a person has the right to defend their home. But the law says you can only use physical force to deter physical force. Grier said he never saw anyone pull out a gun, so a court would have to decide on firing the gun.

Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

That ShotSpotter technology pinpoints where a gun has been fired within 35 feet. Police said it also detected two other shootings in nearby Roosevelt that night.

    About 17 years ago, in El Paso, I took out a twice-convicted drug dealer who had other felony convictions. The legal system failed me and the guy I killed. My shotgun didn’t. Problem solved.

    If there were 20 gang members around him, he should have been able to use lethal force do to a disparity of force that existed (one guy with gun versus 20 punks, some issuing death threats to him and his family). Disparity of force is recognized in the legal community as a factor in determining what “reasonable force” is. One armed guy up against 20 guys that can physically kill you, and have said they will, with hands allows the one guy to defend himself with the gun. Period. He asked them to leave, more show up and threaten him. I’d have taken out as many as possible.

    Two factual errors with this story: 1) An actual AK-47 is illegal unless you have a federal permit, so this gentleman had a look-a-like; 2) AK and AK-47 Look-a-likes fire a medium-powered round, not high-powered.

      Cole: at LEAST one factual error in your post… An actual AK-47 is illegal unless it is Semi-Auto Only OR you pay a federal TAX STAMP.

      No such thing as a federal permit.

      Also, AKs and AK-47 lookalikes fire various rounds, such as 5.56 NATO, 7.62×39, 5.45×45 and have been chambered for other rounds as well. Do some research before you open your mouth and shove your foot in trying to call someone else out.

      It fires a 7.62 x 39 mm round at 2400 fps.
      As long as it isn’t full auto it’s legal.

        Yes, xcon, that’s a medium powered round and if you get it to 2400 fps you are either a reloading stud or your chronometer is very generous. Technically, both the AK and the M16 rounds are medium powered. Not something to take on a deer hunt unless your primary weapon is your truck bumper.

    Most likely the New Jersey laws is such that a weapon outside the home is the problem. Now if those bad guys were to enter the house then he’d have been able to whack them in a more controlled way such as using the doorway to “funnel ’em in” so to speak.

    The courts have already ruled that the police cannot be held responsible for your safety. Wise up people and elect officials who make laws that allow you to protect yourselves. Google the “make my day” law in Oklahoma. Under that law, this man would have been within his right shoot that ahole threatening him and his family. Until that option exist, those criminals will continue this threatening behavior..

    Lots of people lose their thinking when they hear of a citizen with a gun. This is an example. The AK-47 is not a high powered rifle, it fires the rather anemic 7.62 X 39mm. And I’m sorry he got arrested but if he had not taken action he and his family might be dead. In fact if the cops take his gun those thugs might return and he’ll be helpless.

    “high powered AK-47” There is no such thing as a “high powered” AK-47. And it probably really wasn’t an AK-47 but maybe an AK-47S.

    Like good “journalism” the Devil is in the details. The weak 7.62×39 (AK-47) bullet was designed to pierce 2 wool winter overcoats. Otherwise it was selected because it was light, cheap and easy to carry. (The some sort of criteria used to select the 5.56 or .223 M-16 round.) The average deer rifle is
    much more “powerful”.

    An AK-47 is a “machine gun”, the “S” on the end of the number means that the gun is “semi-automatic” only. Now we all know that the Associated Press has spent years muddying the waters about this but its really simple. Machine guns shoot as long as the trigger is pulled. Semi-automatics fire one shot for each trigger pull.

    Now there are only a few literally bankrupt states where these stupid laws still exist New York is one of them. (Hint, look for Democrats running things into the ditch.)

    The argument that the guy would rather protect his family than just be the topic of another unionized police report is persuasive to anyone with any experience with criminals, with badges and without.

      the 7.62 known here as the 308 winchester is a very powerful round used for hunting large game Elk Bear etc.

        AK’s do not shoot the .308, genius. You are uninformed when it comes to ammo. The 7.62×39 is the AK round, the 308 military designation is 7/.62×51 and far more powerful. No, the AK round isn’t much to brag about. Get it straight before you post.

        Wrong 7.62. The 7.62 that an AK-style rifle uses is a 7.62×39. The .308 Winchester that you are referring to is a 7.62×51. Very different cartridges with very different ballistic properties.

        The 7.62×39 is a round much less powerful that a .308 Winchester (7.62×51). The 7.62×39 is very much, ballistic wise, like a 30-30 only they shoot spire point bullets. While still pretty powerful, they only deliver a little more than half the “power” of a 308. A 308 pushes a 180gr bullet about around 3200 fps while the 7.62×39 pushes a 150gr bullet at about 2800. Good enough for shorter range. At the ranges we’re talking about (100ft) an AK is probably not much different from anything else. But, that bullet will travel on through most anything. Rifles are not for the city, unless frangibles are used. I do have a load that I used in the 30-06 (the predecessor of the 308) where I push thin jacketed, light .308 diameter hollow point pistol bullets to the edge. They literally explode when they hit anything. Turn to explosive dust at 4000fps. Those would be a good load to use in town. I use them to decapitate stray dogs that attack my cattle. They’d work on the thugs. There is a reason they have such laws in New York. The people that buy off the politicians don’t like their people shot up. So, they pass the gun laws to keep the sheople in line and docile. When NYC burns to the ground and all the two legged rats flee, order (and self defense) will return.

        The 7.62×39 is an assault rifle cartridge, a downloaded version engineered to cycle rapidly and without fail. The 7.62×51 NATO is the 308 Winchester which is completely different; and I wish we had a battle rifle in 7.62 NATO. Oh right, we did. The M14 and I bet 3/4 of the troops in Afghanistan would rather have an M14 than an M16 or an M4.

        No, that is not true. The AK-47S uses 7.72X39, a lower powered round than the .308 deer rifle, also know as the 7.62 NATO (7.72.51). The only commonality is the 7.62 diameter, which is essentially a .30 cal. cartridge size is smaller as is the powder charge.

        7.62×39 – the round used in SKS, AK, and other commiebloc rifles.
        7.62×51 – the round used in the M60, M14, M24, and numerous other US and NATO designs.
        7.62×54 – the round used in the Mosin Nagant, PK, and other commiebloc rifles and machine guns.

        All will penetrate body armor nicely, at least the soft stuff. BTW, so does 5.56×45, the stuff you were poo-pooing. Any will do the job nicely.

Where were the police when this family was in danger? We will see if any jury will convict this brave man for his actions in trying to keep his family safe.         Pompey, I’m in SC too. I don’t own an AK-47, as I would rather choose my target and hit it than just spray and pray. Granted, your AK could be more finely tuned than the average, so I give you benefit of the doubt. However, it needs to be said that law-abiding gun owners in SC do just that …abide by the law…and only use lethal force when met with a similar threat to yourself or others. You don’t shoot to defend your property. You don’t shoot to scare. When legal and necessary, you choose your target, consider the safety of innocents, and neutralize the threat. Please don’t give the impression that South Carolinians are a bunch of trigger-happy rednecks. Those who own and/or carry legally are correctly exercising their 2nd Amendment rights. I don’t know the law in NY, so I can’t comment on Mr. Grier’s actions. I can, however, understand them. Oh…BTW…get yourself a Mossberg 590 for inside threats, and a good AR-15 for when the SHTF.

          Here in Idaho, we have Open Carry laws. We have the 2nd most lenient gun laws in the Nation…and the LOWEST violent crime rate. California has the strictest gun laws…and the HIGHEST violent crime rate. New York has strict gun laws…and high violent crime rate. Doesn’t take a genius to connect those dots. In Idaho, you don’t get many armed home invasions or violent crimes. Why? Because the Criminals and Gang-bangers…who get guns no matter how many laws you pass…think twice before invading a home and family here. We all have lots of guns…and we all shoot very well.

The fact that it was written by a gangster leader of the F Points Irish gang so he could issue a license to carry to his gang and deny a license to the rival gangs might explain why crime in NYC is higher than in upstate NY and far higher in places like Wichita, KS, Texas, Wyoming where a citizen can get a license to carry.             Guns are too easy to get in this country. period. I do think this man was in the right, this country shouldn’t of been able to get this out of control. I’ve had the pleasure of living in a country where gun control was the farthest worry from their lives. Here gang members have them, police carry them, your kids have them, your grandma has them and we are proud of this chaos? I asked a friend from said country what the basic stereotype of Americans was. He said “really dumb (almost retarded) gun toting, psychopaths.” Wow, that’s embarrassing.

      Agreed, Elian. The Constitution and “man’s” law are two different things with two different purposes.One is to protect and the other is to control..
      It can’t be much different across the country but I had a cop stop when I was walking home one night, I was walking on the side of the road. He tells me I was trespassing and if he saw me again he would put me in jail. I have learned a few things since then, one being the cop is full of chit, I contacted the city and asked them, since there were no signs saying anything and cars pass there constantly.
      I also got the oath the officers pledge before they become officers, it is: “I do solemnly swear that I will support and bear true faith and allegiance to the constitution and laws of the United States of America and the State of Arizona; and to the charter and ordinances of the City of Phoenix, and that I will faithfully and impartially discharge the duties assigned to me as a police officer according to the best of my ability, so help me God.” I see contradiction between the constitution and “man’s” law.

        Except that states did not have a legal right to leave. The courts decided such:

        Could they leave? Sure, but it wouldn’t be legal and the government that exists under the Constitution would have a duty to take action against that illegality.

        It’s like signing a legal contract and then trying to duck out of it later. Sure, you could do it, but don’t be surprised if the government comes after you to either make you do it or you get sued in court for the damages you caused by breaking the contract.

      Very true although under amendment 2 all has the right to protect themselfs criminals or not it was was not till later on the us government passed laws sayings criminals don’t have that right and with all the new illegal laws now days your are a felon and or criminal for a minor offense but that’s how they control guns etc also no where does it say the person in attempt must of a hacious crime has to act before you defend yourself that again is a later law more or less sayin they shoot at you and if your lucky you can defend yourself shootin back he acted corresctly defending himself and family it don’t mateer if it was one person a group or a gang he felt threaten and was acting in defense and now his rights will be stripped by illigal laws put in by an illegal government

If the law isn’t going to get the job done then what can they expect but to have citizens doing this? If you ask me the home owner showed a great deal of restraint by firing into the grass instead of shooting some of those dirt bags.

      Where is the court case being held? everyone in long island/new york should go protest, this guy was just defending his family…. if the guys family is harmed while he is under arrest, the police are directly responsible for their harm and should be thrown in jail for the death penalty.
      This is getting stupid… since when is it illegal to deffend your home from invasion, what was the guy supposed to do? wait till they where raping and killing his wife and kids to take action? the gang made a clear and present threat that they intended to enter his home and do harm to his family… I would of shot them in the knees at the very thought of the word.

      That’s right, “laws” serve no purpose- we should get rid of them all. In fact, we should encourage everyone in the suburbs to carry a Kalashnakov and fire it whenever they feel threatened. Oh wait- this isn’t Kandahar. If the facts show this man had good reason to fear for his life, no jury will convict him. But verbal threats and trespassing aren’t a good enough reason to discharge a military weapon in a neighborhood.
