Long Island Man Arrested For Defending Home With AK-47

Says Many Gang Members Were Coming After His Family

UNIONDALE, N.Y. (CBS 2) — He was arrested for protecting his property and family.

But it’s how the Long Island man did it that police say crossed the line.

He got an AK-47 assault rifle, pulled the trigger and he ended up in jail, reports CBS 2’s Pablo Guzman.

George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home.

“I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said.

Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.

“He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said.

Grier was later arrested. John Lewis is Grier’s attorney.

“What he’s initially charged with – A D felony reckless endangerment — requires a depraved indifference to human life, creating a risk that someone’s going to die. Shooting into a lawn doesn’t create a risk of anybody dying,” Lewis said.

Grier said he knew Nassau County Police employ the hi-tech “ShotSpotter” technology in his area and that the shooting would bring police in minutes. Cops told Guzman he was very cooperative.

Grier also said he was afraid the gang outside his house was the dreaded MS-13. And Nassau County Police Lt. Andrew Mulraine, head of the gang unit, said MS-13 has 2,000 members in the county.

“They’re probably the most organized. They almost have a military hierarchy within the gang, so they are the most organized gang we encounter on a daily basis,” Mulraine said.

You may think a person has the right to defend their home. But the law says you can only use physical force to deter physical force. Grier said he never saw anyone pull out a gun, so a court would have to decide on firing the gun.

Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

That ShotSpotter technology pinpoints where a gun has been fired within 35 feet. Police said it also detected two other shootings in nearby Roosevelt that night.

    Self defense is common sense. Mr. Grier exercised common sense by his choice to defend himself and his family from the “pack of wolves” at his door. What was he supposed to do? Wait for them to make good on their threats to him and his family? Hope the police would arrive before someone was killed? If he had, we all would be reading a much different story. I am glad we aren’t reading that one. Too many people are dying and seriously injured by criminals with more rights than decent citizens. Gangs must stop. Zero tolerance. Life imprison or death penalty.

    “High Powered” is a reporter definition for not knowing anything about firearms. An AK47 round is actually considered a medium powered cartridge.

    7.62 low powered? I wouldn’t want to be shot with one. Same ammunition used by an M14 or an M-60 machine gun. Standard NATO round.

      7.62x51mm NATO has more powder than the 7.62x39mm used in the AK-47. So technically, the AK round could be considered a “low” powered 7.62. Still puts a hole in you though. & would work just fine for 20 gang bangers in your house/lawn.

    Have to laugh at Bill and his comment on AK47’s They are high powered whether they are full auto or semi, they still use the same 7.62×39 ammo.

    I own one which is certainly not a “look-alike wannabe” it is simply a semi-auto only . It started life as a full-auto in Poland actually (mine is a Polish under-folder). The lower receiver was made in Texas, and the rifle was reassembled in Arizona, where men are men and illegals are nervous.

    Whether a weapon is “High’ or “Low” powered refers to the round not the selected fire mode (semi-auto or full-auto). My model 70 .270 is a high powered rifle. So is my AK47.

    I was an auto-rifleman in the 1/505infantry in the 82nd Airborne. When I switched my selector to full from semi it did not become a low powered rifle magically. HAHA what a concept.

    I applaud the man for protecting his home, family, and self. It is too bad you cannot have the freedoms we have in Arizona. We can conceal carry with no permit, and can protect our homes and vehicles under a “Castle Law”.

    Texas has almost as much firearm freedom as we do.
    Apparently in NY, they want to protect you at the morgue. It’s a tad too late then.

    So there’s a part of the story missing here somewhere. The whole ordeal started when he went to drive his cousin home….he’s aiming a gun at a group of men.
    Where is the stuff in the middle that possibly provoked the situation? Only wondering.

    I have to believe this man did something that we aren’t reading about in the news report. Why would dozens of gang members surround his house out of random? Even so, he should have dared one of THEM to draw a weapon. You know how most of these thug POS’s like to hold their handgun sideways and whatnot to look cool.     Mr. Grier is charged with a crime that requires not only a risk of death from his actions but that his actions evinced a depraved indifference to human life. Mr. Grier showed a tremendous amount of restraint in firing into the lawn and not into the crowd. The only thing that was at risk of death that night was a few blades of grass. That’s just one legal argument. Even here in New York one can use deadly physical force (which Mr. Grier did not) when faced with what reasonable men in the same situation would believe is deadly physical force being used against them. I don’t think any reasonable person when threatened and then rushed by 20 or so gang members would think that deadly physical force was not justified. Both Mr. Grier and I have the utmost confidence in the New York criminal justice system. He will be vindicated!

    The left has done their best to insure that only criminals have firearms, at least in the big cities. Get ready to see lots of your women raped. In the left’s utopia, they provide most of the clients for the gangs’ drugs and other criminal activities (looters and leeches), insure that the gangs are relatively unmolested and armed, and that the populace at large is disarmed. Great system if you’re comfortable with mass murder and concentration camps. The world ends in ruin if the left gets its way, because we will not be their slaves.

    The judge and prosecuter made the OJ Simpson people look brilliant. Mr. Ferguson made them all out to be fools.
    One of the victims widows ran for Congress and was elected. This type of legislation is her specialty.

    I’m 100% with the home-owner but you don’t fire any weapon for effect, only to kill or hopefully wound. He should have locked the doors got his family on the floor behind him and if they came in, drop the 1st folks who touch that front door. He was “posturing” just like the gang members. His ego and fear (very natural reaction) got in the way of protecting his family. They could have shot him when he stepped out and had his family all to themselves. I’m 100% super “lefty” and it pains me to see non-factual firearms knowledge in the press, especially from people I believe are smart and on the correct side of things. I’m just glad no one got hurt but this family needs to re-arm itself in some legal way asap. PS– if any journos would like un-biased gun info please make it known, I’ll help you get it correct so your story is not shot-down by the gun-fans before it gets it’s due.     New York needs three laws to clean up this mess (1) Absolute castle doctrine that trespassers can be shot – no duty to retreat against property invaders; (2) no civil liability for shooting trespassers; (3) no sovereign immunity with punitive damages against localities that deprive homeowners the right to practice law (1) by, for example, confiscating a gun/arresting homeowner who lawfully shot trespasser. What sense does it make to have a right to self defense if using it once means the cops confiscate your gun and arrest you?

    Sorry, but the picture above is not an AK47 but a civilian version of one, Also an AK47 is NOT a high powered rifle. In fact it shoots a 7.62×39 which is pretty darn similar to a 30-30 used for deer hunting.

    Thats true in Cali. The cities are full of this garbage, but in the counties surrounding everybody is armed and well trained. CA is still pretty conversative outside of the dense population and illegals.
