Long Island Man Arrested For Defending Home With AK-47

Says Many Gang Members Were Coming After His Family

UNIONDALE, N.Y. (CBS 2) — He was arrested for protecting his property and family.

But it’s how the Long Island man did it that police say crossed the line.

He got an AK-47 assault rifle, pulled the trigger and he ended up in jail, reports CBS 2’s Pablo Guzman.

George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home.

“I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said.

Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.

“He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said.

Grier was later arrested. John Lewis is Grier’s attorney.

“What he’s initially charged with – A D felony reckless endangerment — requires a depraved indifference to human life, creating a risk that someone’s going to die. Shooting into a lawn doesn’t create a risk of anybody dying,” Lewis said.

Grier said he knew Nassau County Police employ the hi-tech “ShotSpotter” technology in his area and that the shooting would bring police in minutes. Cops told Guzman he was very cooperative.

Grier also said he was afraid the gang outside his house was the dreaded MS-13. And Nassau County Police Lt. Andrew Mulraine, head of the gang unit, said MS-13 has 2,000 members in the county.

“They’re probably the most organized. They almost have a military hierarchy within the gang, so they are the most organized gang we encounter on a daily basis,” Mulraine said.

You may think a person has the right to defend their home. But the law says you can only use physical force to deter physical force. Grier said he never saw anyone pull out a gun, so a court would have to decide on firing the gun.

Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

That ShotSpotter technology pinpoints where a gun has been fired within 35 feet. Police said it also detected two other shootings in nearby Roosevelt that night.

    Typical government reaction. Prosecute those who are being victimized by gangs and are brave enough to stand up to them. After all the government is just another bunch of thugs at this point, and I’m sure their main concern is that any resistance on the part of a citizen is crushed, rather than making any real effort to protect their herd of “cash cows” from depredation from other gangs. They probably secretly regret that MS-13 didn’t take care of the problem for them.

    This man is a hero. He even held back and did not shoot them. A dozen plus gang bangers shouting threats in your yard is no small matter. The pigs seem to be the danger here. We need our guns to protect against criminals but also to withstand a government gone berserk.

A tainted, lawless area should be ejected out of the union as a sovereign entity and becomes an occupied territory, i.e., no evil congressmen, only to be readmitted on several conditions, i.e., 99% of all occupants are legal citizens, the murders drop below 1 in 100,000; property rights are restored; etc.

    Due to MS-13 gang concentration, U.S. citizens in that area must prepare for civil war. This man should have defended his family from inside the structure; even then, one must have secure walls/barriers and fire escape airway devices / masks. Me, I’d get my family out of there until area sanitized of this disease. This is war, as I said before. MS-13 is an organized crime plague and a local count of 2000 soldiers constitutes an invasion (witness Mexico’s cancer). We readers need an address of a Church or other group providing help to this family.

    This man is a true hero. He showed remarkable restraint in not smoking a full clip load into the gang members and if he had less than 20 reloading and getting the rest.

    If the rest of us would do this in our homes the gangs would get the message “DON’T MESS WITH US”

    A gun is needed to be seen before a gun is used in self defense? Silly! I guess a knife, sword, chainsaw or club wouldn’t apply? Perhaps the reporter would care to look up the legal principle of “disparity of force”, especially as it applies to a gang of 25 people attacking a single person? Or “furtive gesture”.

It’s sad that lawyers and politicians have made it impossible for New Yorkers to do so with their stupid little legal word games for determining when someone is allowed to use deadly force to defend themselves.

    There is a simple solution to this man’s legal trouble and it involves each person reading this article: JURY NULLIFICATION. Each juror has the right to find the defendant not guilty of any charge to which they have a moral objection. You will not be told this by the judge. Take a look at: http://www.fija.org.

    Police normally will not do anything untill after a crime has been committed. He said/they said untill that happens. By then it is too late for the crime victim.

    I envy you fellas in Texas and Arizona. Down there, folks still have common sense , and you would have had 20 dead gang members and Mr. Grier would have had the appreciation of the community. NYC is NOT America. Its a complete disgrace.

    So this man was not in imminent danger because the gang didn’t have “weapons”. That makes resisting arrest legal right? There is no chance of danger…so I demand that anyone who has EVER been arrested for resisting arrest be let free and compensated.

I would have waited until one of them crossed the threshold of my door. Then fired :in fear for my life”. One to the head, one to the chest and one to the gut. The others would have fled in complete panic. They are not trained assault troops. They are punks waiting for the biggest dog among them to lead the way.

    The solution is simple. He can’t be convicted if one person on the jury finds him not guilty. It’s jury nullification. Judges increasingly disregard the law, why shouldn’t citizens. The U.S. Justice Department has, in effect, declared an end to the social compact. We all need to protect ourselves and our families and refuse to convict anyone who is doing so.

    We had many cases in Texas where the gangs would enter the home, armed but if the homeowner wounded one of them, the perp, often illegal aliens ,would then sue them for bodily injury and be awarded millions. Texans got tired of the craziness ,demanded and got the Castle Law passed. Now, if a perp enters a home , he can and is often shot down . No more ambulance chasing lawyers to enrich the felon through lawsuits. If a homeowner feels threatened and in fear for their life, they can legally take action. Finally. One less problem.

    What an impossible situation for one man to attempt what the entire police force can’t do. Let us say he killed a few creeps. The harassment by survivor gang members and their friends would not end and his entire family would have been snipered. Sometimes it’s better to turn the other cheek–no! both cheeks as you re-locate to a civilized area.

    @XJRacerik: Texas did join the union willingly in 1845 because we were in massive debt from our war of Independence, and Mexico would have likely invaded Texas again, and won. Some of the conditions was that we could split into separate states, we could fly our flag as high as the united states flag (all other states must be below the Union Jack), and we could leave the union. However after the civil war it’s unlikely that would be allowed. Had Texas left the union and not joined the confederacy it might have stood a better shot.

    He should have stayed in his home with his weapon, called the police and WAITED until they arrived to clear out the gang. Very dumb to go outside and threaten them. Now he’s a marked man. If he would have stayed inside then he would have had every right to blow any one of them away if they tried to enter.

    This is Long Island, the place were black gunman Colin Ferguson went to kill unarmed whites. They elected a gun control nutjob as a result of that massacre.

    Long Islanders chose to remain unarmed and to be the victims of gangs. Of course this man was arrested. He chose to live there.

    Er … when it’s one guy against a bunch of people – let alone 20! – who are threatening to kill him and his family, he is certainly within his rights of self-defense in firing the gun. Any judge who doesn’t understand that simple fact should be thrown off the bench.
