NY Man Jailed After Bringing Beer To DWI Hearing

MONTICELLO, N.Y. (CBSNewYork/AP) — Perhaps he was using it as evidence … against himself?

A 49-year-old  Sullivan County man was sent to jail without bail Monday after authorities said he showed up an hour and a half late for a court hearing on a felony DWI charge. If that wasn’t bad enough, Keith Gruber was intoxicated and was carrying an open can of Busch beer and had four more cans in a bag when he went through the courthouse security check, police said.

Gruber, of Swan Lake, appeared Monday before Sullivan County Judge Frank LaBuda, who asked him if he enjoyed his “liquid lunch,” The Middletown Times Herald-Record reported. Gruber said he did, then said he was sorry. LaBuda sent him to jail with no bail.

Gruber, who has prior DWI convictions, was arrested on Dec. 27 in the town of Liberty and was out on $30,000 cash bail.

    I grew up with this guy. He is an incredible guitar player, and has more talent in his pinky than most of us do in our whole body. I hope he works through it. There are others that deserve prison more.

    i hate to say it but that man has a very serious condition of alcohalisem and that is just plain old sad…..cause he really has a very serious poroblem and the judge needs to send him to rehab not jail cause that is not going to help him in any way shape or form as you can clearly see…

      He has been to rehab many times…sad …he is a very, very, very talented guitarist. He just can’t leave alcohol alone. 30 days in rehab and he will drink as soon as he is out. I hope someone will really try and help him as he can’t seem to control this. He is a very nice guy and somewhere he deserves to get better. It is true what Cowboy Roy said about his talent. He has played with MAJOR bands but the drink always brings him down.

    Being a recovering Alcoholic of 15 years at one time behavior like this seemed perfectly normal. In his sick mind he probably thought no one would even notice. The key word here is SICK and thats what the true problem is here. Throwing him in jail is what most peoples first thought usually is in what should be done with him, but don’t sick people go to doctors? hopefully this will be the straw that allows him a moment of clairity and this mentally sick soul will be aloted his due chance at RECOVERY lets try saying a prayer instead of prosicute good day to all!!

    A standard condition of bail in a DWI case is drug and alcohol conditions. Consuming alcohol openly in front of the Judge presiding over a case is an obvious violation of that condition and the Judge had every right to put him in jail.

    It was a hearing not a trial…………..late , drunk thus unable to assist in his defense, judge had every right to throw his ass in jail till such time he is sober enough to participate in his defense.

    First no one found him guilty of anything it’ wasa hearing. If he was intoxicated in the courtroom then the Judge has the right and duty to have him held w/o bail till such time he is sober enough to assist in his defense.

    If it was legal for the guy to purchase beer it’s a travesty of justice to imprison him for consuming his purchase. Accordingly murder is then legal as long as it’s not done in public. States are run by hypocrites who milk the populace with their “legal” lotteries but don’t allow gambling. Just another example of Uncle Sam holding you by the balls.
