Accuser In NYPD Rape Trial Leaves Witness Stand

NEW YORK (CBSNewYork) — After another day of gripping testimony, the accuser in the rape trial of two New York City police officers is finished on the stand.

Monday marked the 29-year-old fashion industry executive’s third day of testimony.

The accuser alleges NYPD Officers Kenneth Moreno and Franklin Mata raped her in December 2008 while she was drunk inside her East Village apartment.

The woman insisted she has no doubt police officers were with her that night. Her testimony may cause the officers to take the stand.

Prosecutors were also expected to present medical evidence Tuesday.

A dramatic moment in Monday’s testimony came as the prosecutor asked the woman how certain she was of her story.

“As you sit here now, do you have any doubt that those were police officers behind you (as you went to your apartment)?” the prosecutor asked.

“No,” the woman replied

The prosecutor continued: “…That as you lay face down on your bed, your tights were rolled off your legs?”

“No.”

Prosecutor: “And do you have any doubt that you were raped by a police officer on your bed?”

“No.”

The alleged victim began to sob and visibly shook as she apologized, asking Judge Gregory Carro for a moment.

The judge excused the jury, but during the recess defense attorney Joseph Tacopina, visibly angry, accused the DA of leading the witness.

Judge Carro overruled the objection, ruling the defense, during cross-examination, opened the door to every point made by the DA.

“Look, I object when I think something is wrong, but I think in the crucial witness in this case, the witness whose story it is to tell, it should be her story to tell,” Tacopina said.

While on the stand – the woman also re-stated her claim she heard two voices in her room that night.

It’ll be up to jurors to determine the weight of that testimony because prosecutors allege 27-year-old Officer Mata was an active accomplice.

Surveillance video shows both officers re-entering the woman’s apartment, using her key four times that night to allegedly search her bedroom afterward to make sure they left no evidence behind.

    I live in really ‘not good’ neighborhood in The Bronx. During the past year, I made several 911 calls to report incident such as, ‘Kids fighting/shouting on the street at the middle of night’, Innocent passer by getting robbed and beaten. Unfortunately cops rarely showed up on time. If I made follow up call after an hour or two to see what is the status or how far the cops are? 911 operators would say, cops have other emergency to take of first. Ken Moreno’s’ case is an example of cops having other emergencies which are much more severe than a street fights or robbery!!!!

    even a 3 year old kid would know those 2 fu@king NYPD’s raped the girl. they’re fu@king trying to twist the case. the whole fu@king department and the whole fu@king US gov’t is trying to protect those 2 lowlifes

    My “ex” husband is a retired cop. He pulled a woman over for drunk driving and didn’t arrest her….didn’t even give her a ticket. Instead, he followed her home to make sure she got home ok. She herself testified at our “divorce by jury” as his witness

    An innocent man would never admit to rape just to get someone to leave them alone! He said – yes I used a condom. Sorry – case closed. He wasn’t being water boarded – she was just asking him if he raped her and if he used a condom. Guilty

    As always, we are only allowed to know certain aspects of the case, but what is troubling to me is you have an officer with 17 years on the force and this is the first time he is being accused of rape? Personally, I feel you would have scores of women coming forward if this was the type of ‘animal’ he really was. And just another ‘crazy’ thought-how long was she alone with the ‘well meaning’ cab driver? Could he have attacked her, assuming there was an attack? Before you say ‘No way’, she states she doesnt even remember the ride home. Its all just food for thought, but after reading that undercover transcript, I felt compelled to believe the officer…

    Find it difficult to understand why they enter her room four times. Something out of ordinary did happen that night but is hard to comprehend what. The Officers must be warned

    The question is why did they return to her appartment four times using her keys. Once she was secured in her apartment the first time, their duty was done.
