NEW YORK (CBSNewYork) – A Suffolk County man will be arraigned on Saturday after police arrested and charged him with aggravated DWI with a child.

Police said they stopped 29-year-old Christopher Weiss, of Nesconset, at 12:35 p.m. on Friday after receiving a call about a car driving without one of its front tires.

When police found the 2002 black Ford Focus hatchback traveling eastbound on Route 25 in Huntington, they determined Weiss was intoxicated and also discovered Weiss’s 2-year-old son in the back seat, according to the police.

Weiss’s charge of DWI with a child counts as a felony under Leandra’s Law. He also faces one charge of endangering the welfare of a child.

The unharmed boy was released to a family member.

    the article doesn’t say, so let’s hope he’s in jail until his arraignment. somewhere, yet another village is no missing it’s idiot. what don’t these fools understand? the 2 yr old and any siblings should have an order of protection against dad. taking the license away & community service doesn’t cut it. thank goodness for leandra’s law. maybe every car needs to be fitted with a device to prevent it being started for alcohol levels under the minimum. whoever served the alcohol should also face charges. i’ve seen the victims of both levels of idiots in emergency rooms. tough sentencing, you bet!
