Sands Point Psychiatrist Accused Of Raping Patient

FLOWER HILL, N.Y. (CBSNewYork) -- A Long Island psychiatrist has been arrested on rape charges.

Dr. Marshall Hubsher, of Sands Point, is accused of raping a 32-year-old female patient around 8 p.m. on April 3 during a treatment session at his office on Northern Boulevard in Flower Hill.

The patient was being treated for depression and told police the alleged rape occurred during her second session with Hubsher, Det. Sgt. Carlo Maltempi said.

The 62-year-old married father of two has been charged with third-degree rape and third degree criminal sex act.

He has pleaded not guilty to the charges. Bail was set at $50,000.

EXTRA: State Report On Dr. Marshall Hubsher (pdf)

Hubsher has a history of fraud and deceit, according to state records, dating back 30 years.

His license was suspended for more than a decade before the state allowed him to practice again in 2006 after concluding that he had "almost no chance" of further misconduct.

A sign outside his office Thursday read, "Dr. Hubsher was called out of the office today, April 19th, due to an emergency. Sorry for the inconvenience."

His colleagues and patients expressed shock over the arrest.

"You're supposed to be able to trust a doctor, especially a psychiatrist," Dr. Lee Nissensohn, a dentist in the neighboring office, said.
