NEW YORK (CBSNewYork) — A 66-year-old Staten Island man is dead, after being hit and killed by a private garbage truck in Chelsea.

Around 2:20 p.m. Friday, Thomas Berry was crossing to the west side of Ninth Avenue at 29th Street, when he fell into the rear wheels of the slow-moving sanitation truck that was headed south on Ninth Avenue, police said.

Berry, of 56 Crescent Ave. in Staten Island, was taken to Beth Israel Medical Center, where he was pronounced dead.

The operator of the 2007 Mack truck that hit Berry remained on the scene. No charges will be issued against the driver, police said.
