Lawyer: Actor Stephen Baldwin To Avoid Jail In Tax Case

NEW CITY, N.Y. (CBSNewYork/AP) -- Stephen Baldwin's lawyer said the actor will avoid prison and get up to five years to pay back taxes of about $350,000.

Attorney Russell Yankwitt spoke Monday after a closed-door conference with prosecutors and a judge in Rockland County.

Baldwin, of Grandview, is accused of skipping New York taxes in 2008, 2009 and 2010. The district attorney said Baldwin owed more than $350,000 in tax and penalties.

Yankwitt said that under a tentative agreement, Baldwin will plead guilty this month to a tax felony.

If Baldwin pays the money within a year, his record will be wiped clean, Yankwitt said. If not, he will be sentenced to probation and given five years to pay back the money.

Baldwin has been free without bail since his arrest in December.

Baldwin, the younger brother of actor Alec Baldwin, is perhaps best known for his role in 1995′s "The Usual Suspects."
