L.I. Drunk Driver Sentenced For Crash That Killed His Daughter

RIVERHEAD, N.Y. (CBSNewYork) - A Long Island man who pleaded guilty to a drunk driving crash that killed his infant daughter has been sentenced.

Jose Escobar, 30, was sentenced to four to 12 years in prison for crashing into a Brentwood 7-Eleven store last year.

His 10-month-old daughter's car seat was thrown from the car in the collision. Helen was on life support for less than a week before succumbing to her injuries.

As WCBS 880's Sophia Hall reported, Escobar looked down in court as he apologized for driving drunk.

Authorities said his blood alcohol level was more than three times the legal limit.

Police said Escobar was drunk after buying a six-pack of beer and speeding on the Long Island Expressway service road in Brentwood when he lost control of his Nissan. He spun off the road and went airborne before crashing into the back of a 7-Eleven, police said.

His pregnant wife was also in the car at the time of the accident.

She had to have an emergency Cesarian section and the little boy survived and is healthy.

Prosecutor Patricia Brosco said Escobar's wife begged for leniency for her husband.

"She knew he was drunk, so she allowed her child to be driven by her husband, driving at speeds up to 100 miles an hour. It's very disturbing, I mean this is a horrible thing that happened," Brosco told Hall. "She used to visit him in jail. The District Attorney was the only one speaking on behalf of this child."

Brosco added that the mother did not cooperate with police and didn't visit Helen in the hospital before her death.

Escobar has faced up to 25 years in prison.
