Katherine Heigl Sues Duane Reade Over Use Of Photo

NEW YORK (CBSNewYork/AP) -- Emmy-award winning actress Katherine Heigl claims the ugly truth about Duane Reade is that the pharmacy chain is using her image in promotional materials without her consent.

The 35-year-old actress, who has starred in the TV series "Grey's Anatomy and the movies "Knocked Up" and "The Ugly Truth," filed a lawsuit against the company Wednesday in Manhattan. Heigl claims she was recently photographed by paparazzi in New York City as she left a Duane Reade pharmacy and that the company is exploiting her image for commercial gain despite her objection.

Duane Reade tweeted the photo March 18.

Heigl is seeking $6 million in damages and says in her complaint she plans to donate any lawsuit proceeds to a charitable foundation that helps animals.

A Duane Reade spokesman did not immediately return a message seeking comment.
