Actor Shia LaBeouf's Disorderly Conduct Case To Be Dismissed If He Avoids Arrest

NEW YORK (CBSNewYork/AP) -- A judge has told actor Shia LaBeouf that a disorderly conduct case against him will be dismissed and sealed if he avoids being arrested in the next six months.

A prosecutor told Manhattan Criminal Court Judge Ann Scherzer on Friday the "Transformers'' star has completed a treatment program following a June arrest at a Broadway show.

LaBeouf said nothing to reporters as he climbed into a black SUV following his brief court appearance. Wearing a dark suit, he sported an eyebrow piercing and a braided rat tail hair style.

LaBeouf was charged with criminal trespassing and two counts of disorderly conduct after he disrupted a performance of "Cabaret" at Studio 54.

Witnesses and police said LaBeouf was yelling profanities inside the theater and later spit on a police officer.

Two theatergoers told CBS2 they saw him in a ripped shirt a block away from the theater while they were walking to the show. They said LaBeouf was chasing after a man who appeared to be homeless.

The witnesses said they also saw LaBeouf stumbling inside the theater and in the bar, and feeding a woman a strawberry from her own plate.

Police said LaBeouf was also smoking inside the theater and refused to stop.

LaBeouf pleaded guilty in September.

Representatives for the 28-year-old actor have said he's been treated for an alcohol problem.
