Charges Rejected For Retired Correction Officer In Shooting That Killed Man In Subway

NEW YORK (CBSNewYork) -- A retired New York City correction officer will not be charged in the shooting death of another man in the subway in Brooklyn back in March.

Video obtained exclusively by CBS2 captured William Groomes, 69, firing the shots that killed Gilbert Drogheo, 32, at the Borough Hall subway station in downtown Brooklyn. The shooting followed a scuffle in the subway.

Brooklyn District Attorney Kenneth Thompson said criminal charges are not warranted in the case. That means the matter will not even go to a grand jury.

The cellphone video captured Groomes walking through the station, searching for two men after he reportedly had a confrontation with them inside the No. 4 train. He is seen catching up to Drogheo before the two struggle, and the gun Groomes was carrying goes off.

A third man allegedly involved in the quarrel has been charged.

Drogheo's friend, Joscelyn Evering, 28, was charged with two counts of assault and one count of menacing for physically shoving the retired officer on the train.
