Lawyer Asks Charges Be Dismissed In Farmingdale Drag Race Crash That Killed 5

MINEOLA, N.Y. (CBSNewYork/AP) -- A lawyer for a Long Island teen involved in a street race crash that killed five teenagers says his client isn't at fault for the wreck.

An attorney for 18-year-old Cory Gloe, of Farmingdale, asked a judge to dismiss manslaughter, criminal negligent homicide and other charges against his client, according to Newsday.

Gloe was indicted in January in the May 2014 crash in Farmingdale.

Prosecutors allege Gloe goaded the driver of another vehicle into the drag race that ended in tragedy. The other driver crossed into oncoming traffic during the race and collided with an SUV, killing himself and four others in the car.

The driver and passenger in the SUV were seriously injured and each underwent multiple surgeries.

Defense attorney Stephen LaMagna wrote in his motion that fault should lie with the alcohol-impaired driver who died.

In filings, prosecutors said that the driver would have been criminally liable, but that doesn't absolve Gloe.
