Brooklyn Man Claims False Arrest After Crash Involving Police Officers

NEW YORK (CBSNewYork) -- A Brooklyn man is planning a lawsuit against the city claiming the NYPD falsely accused him of drunken driving to cover up their own mistakes.

As 1010 WINS' Juliet Papa reported, 31-year-old Oliver Wiggins is still wearing a brace on his arm following an accident that led to what his lawyer is calling a false arrest.

"I realized when the handcuff was on my hand when I was actually in the hospital. That's when I got like 'this is really happening to me. I'm being arrested,'" Wiggins said.

According to Wiggins, NYPD police officers in an SUV ran a stop sign and slammed into his vehicle, then falsely accused him of DWI.

Lawyer Scott Rynecki said Breathalyzers and blood tests all came back negative.

"It is our position that the police officers attempted to do that simply to hide the fact and cover up the fact that they operated their vehicle in a reckless manor," he said.

Rynecki said the Brooklyn district attorney dropped the charges against Wiggins last week. Now, he intends to file a lawsuit.
