WCBS 880 Hit for the Cycle OFFICIAL RULES ( Updated April 15, 2013)
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. HOW TO ENTER
a. These rules govern the WCBS 880 Hit for the Cycle promotion (the “Promotion”) being conducted by WCBS(AM) Yankees Radio Network (the “Station”) beginning on April 5, 2013 at 6:00am Eastern Time (“ET”) and ending on September 29, 2013 at 11:59:59pm ET or the date on which a Grand Prize, if any, is awarded, whichever is earlier (the “Promotion Period”).
b. To participate in the Promotion, log onto Yankeesradionetwork.com any time during the Promotion Period and follow the links and instructions to enter the Promotion and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth and a valid email address in the online entry form. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Promotion. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. All entries must be received by 8 a.m. September 29, 2013.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all persons who are 21 years of age or older and who reside in the tri-state area of New York, New Jersey and Connecticut. Employees of Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the New York metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
b. Persons are eligible to win a prize in a Promotion conducted by the Station only once every thirty (30) days and only once every six (6) months if the prize is valued at $600 or more once every six months. Only one (1) winner per household is permitted in any Station promotion.
c. The winner must provide valid government-issued photo identification, proof of insurance, and provide their complete address, date of birth and phone number to claim the prize.
d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
e. To be eligible, entrants must possess a valid driver’s license and have proof of or be able to obtain automobile liability insurance and/or any other state automobile insurance requirements as of the date the entrant enters and Promotion and prior to taking possession of the prize.
3. PRIZES
a. One (1) Grand prize may be awarded in this Promotion. The prize, if awarded, consists of the following: A 2014 Lexus IS250 as selected by Sponsor in its sole and absolute discretion. The Approximate Retail Value (“ARV”) of the prize is $45,000. The winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the Prize. Winner must provide proof of insurance and a valid driver’s license and must take delivery at a dealership and time specified by Sponsor. All obligations set forth herein must be met before winner takes possession of the car. The winner will accept the chosen prize vehicle “as is.” Station and Sponsor accept no responsibility for repairing any real or supposed damage to the prize car from this Promotion. Neither the Station nor the Sponsor have made or are responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer’s warranty that may apply to the vehicle. Any additional car options (including the interior and exterior color of the prize) not specified herein are subject to availability and any payments associated with such options will be the responsibility of the winner.
Up to one-hundred and fifty nine (159) Qualifying prizes will be awarded. Each Qualifying prize is one (1) medium (12 inches) one (1) topping pizza certificate from Domino’s. ARV is $12.50. The gift certificate will be subject to the terms and conditions as set forth by the issuer of the gift certificate.
b. All prizes or prize certificates will be available for pick-up from the WCBS(AM) studios during regular business hours at 345 Hudson Street, 10th Floor, New York, NY 10014. In the event we have a Grand Prize winner, the vehicle must be picked up at the Lexus of Englewood dealership in 53 Engle St., Englewood, NJ. The winner will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. The Station is not responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Station management with respect to the Promotion are final.
b. Prior to each 2013 Yankees regular season game that takes place during the Promotion Period, one (1) contestant will be chosen at random from among all eligible entries received up to that point (the “Qualifier”). There will be a maximum of one hundred fifty nine (159) Qualifiers selected during the Promotion Period. Each Qualifier’s name will be announced at the beginning of the broadcast for that day’s game. If a NY Yankees player hits for the cycle, which includes hitting a single, a double, a triple, and a home run (not necessarily in that order) during the game, subject to the conditions set forth herein and NOT including extra innings if applicable (the “Prize Winning Condition”), then the Qualifier selected for that game will win the Grand Prize, pending confirmation of eligibility. If a prize is awarded, the Promotion will end and no additional Qualifiers will be selected.
c. For the purposes of these Official Rules, in order to hit for the cycle and meet the Prize Winning Condition, a batter from the New York Yankees must acquire, in any order, a single, a double, a triple, and a home run during a single official game. These must be official base hits as recorded by the official scorer present at the game (i.e. a batter reaching first base on an error is not credited with a single). A batter will have a maximum of nine (9) innings in order to complete the cycle and meet the Prize Winning Condition. The result of any at bats by any player which occur in any inning after the ninth inning will not be acknowledged as part of that players attempt to hit for the cycle. A Qualifier will NOT be awarded the Grand Prize based on the outcome of any at bat made during extra innings. In order for the home run to be considered valid for the purposes of the Prize Winning Condition, the ball must clear the outfield fence on the fly, without the aid of an opposing player or any other person, surface or object. A ball that touches a fielder prior to crossing the plane of the outfield fence will not constitute a winning home run for this Promotion, irrespective of the official scoring of the play. Any home run which occurs as the result of a spectator who in any way interferes with an opposing player who is attempting to catch the ball (i.e. grabbing a player’s arm, removing ball from a player’s glove, etc.) will not constitute a winning home run for this Promotion and will not meet the Prize Winning Condition, irrespective of the official scoring of the play. A home run must be generated by a ball that is hit over the outfield fence. An inside-the-park home run may constitute as a winning home run for this Promotion as long as it is officially scored as an inside the park homerun. The game in which the New York Yankees player hits for the cycle and meets the Prize Winning Condition must be an official game. If the game in which a batter has hit for the cycle is canceled for any reason prior to becoming an official game, all hits are removed from the official score book. Therefore, there will be no winning Qualifier based on this game. No changes by the official scorer on any ruling (i.e. changing an error or a fielder’s choice to a hit) will be acknowledged after the completion of the game. If a game is re-scheduled or postponed for any reason, the make-up game will be eligible for the prize and the selected qualifier will remain. If the game is cancelled and no make-up game is scheduled, the qualifier is no longer eligible to win a prize.
d. Odds of being selected as a Qualifier depend upon the number of eligible entries received at the time of drawing.
e. Qualifiers and the winner, if any, do not need listen to the Station or be present to win.
f. The winner, if any, will be notified the next business day by phone and/or email the following the baseball game the hit for the cycle occurred in. The winner must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of winning or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.
d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.
e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.
h. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by September 29, 2013 to “WCBS 880 Hit for the Cycle – Official Rules,” Attn: Promotion Department, WCBS-AM 345 Hudson Street, 10th Floor, New York, NY 10014. For the names of the prize winners send a self-addressed stamped envelope for receipt by November 29, 2013 to the above address marked “WCBS 880 Hit for the Cycle – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and may be posted online at yankeesradionetwork.com.
6. PRIVACY
a. By use of the Station’s website or by entering the Promotion through the Station’s website, you agree to the website’s Terms of Use Agreement located at yankeesradionetwork.com and to the use of your personal information as described in the Privacy Policy located at yankeesradionetwork.com.
