No. EDU 07239-09. O.G, B.B-G, and D.L.G. petitioners, v. Millburn Board of Education of the Township of Millburn, Essex County.
Judge Ellen S. Bass, ALJ decided: September 22, 2010, the actions of the Board in imposing an expulsion ran a foul of the requirement. The Board is ordered to permit O.G. to return to Millburn High School. Judge Bass filed the initial decision with the Commissioner of the Department of Education for consideration. On April 22, 2009, an Essex County grand jury declined to indict the minister from Short Hills and his college age son on aggravated assault and other charges in connection with an altercation outside Millburn High School. The minister was found not guilty of failure to comply with Officer Directive Statue 39: 4-57; Reckless Driving 39: 4-96; September 17, 2009 at a trial in East Orange, New Jersey due to a conflict with the Millburn prosecutor the case was referred to East Orange Municipal Court.
