Sen. Richard Blumenthal said if federal agencies are not empowered to raise the penalties for safety violations, legislation will be enacted to achieve a higher safety standard.
The lawsuit, which was filed in federal court in Connecticut by Hannah Luden, accuses Metro-North of negligence.
The deadly crash in the Bronx Sunday was the second train derailment in just six months for the Metro-North Railroad, and prevents the rail service with another problem in a year already plagued by safety issues.
Chief Engineer Robert Puciloski, who appeared at the National Transportation Safety Board hearing in Washington, D.C., said the railroad is “behind in several areas,” including a five-year schedule of cyclical maintenance that had not been conducted in the area of the Bridgeport derailment since 2005.

The fact that the NTSB has said that it will take a year and a half to issue a probable cause finding for the derailment and crash is outrageous, Sen. Richard Blumenthal told WCBS 880 Connecticut Bureau Chief Fran Schneidau.
The accident came less than two weeks after a train derailed in Bridgeport, injuring more than 70 people and disrupting service for days on the railroad used by tens of thousands of commuters north of New York City.
