NEW YORK (CBSNewYork) — An off-duty New York City police officer is behind bars after being accused of raping a woman Friday morning in Manhattan.

Michael Pena, an officer since 2008, has been suspended without pay after the alleged incident in which a 25-year-old teacher said she was raped in Inwood.

Deputy Police Commissioner Paul Browne said Pena, described by authorities as being very drunk, asked for directions to the subway.  When the woman refused, he allegedly opened his jacket to display a handgun and told the woman “you’re coming with me.”

Pena, who was coming off an overnight shift, allegedly forced the woman to the courtyard of a building on 217th Street and raped her.  Police said a resident of the building noticed something happening and called 911.

Sources told CBS 2 that when police arrived, the woman came running toward them screaming, “he raped me, he raped me.” Pena was arrested on the spot and police found his badge and ID in his pocket and the gun on the ground.

The victim was taken to Columbia-Presbyterian Hospital and treated.

Friday night at Pena’s mother’s home, the family of the officer had no interest in talking.

“I don’t believe it,” Pena’s brother told CBS 2’s Sean Hennessey.

    As a resident of Inwood, I am appalled by the behavior of the NYPD. Those comments that suggest the race is the reason for the rape are based on ignorance. There is no one to blame for the rape other than that officer. He should be ashamed of himself because he has tarnished the name of both the police and his family.
    As a young single woman, I am now frightened by the NYPD. This is the second incident in the pass 8 months that involve officers in the NYPD and some sexual misconduct. I wonder, am I even safe from police officers now? I used to think that if I walk by, they are the only people I don’t have to be scared of – it seems that I can no longer stand by that.

    I am an Auxiliary P.O. (and very proud of it !) and we are the eyes and ears of the NYPD. We patrol the streets at no charge to Govt and we do this to help our community and keep it safe.We are in very close contact with the regular officers on and off duty.But for the few don’t badger the NYPD .I am sure there are still such officers within the rank and file of the NYPD and other law enforcement agencies and such people exist everywhere in and out of uniform but don’t condemn the entire Police Dept for that. We are devastated when we hear such news.

    Off the wall comment here, but you can tell cops are thugs who ignore the law just by the “file photo” of the cop car sitting in the middle of the painted crosswalk while pedetrians, including a woman with small children, have to walk outside the cross walk to get around the car.

    Police are the same as everyone else. For some reason you guys think you should be treated better or more than just a civil servant. You work for us to help out citizens of the city but spend most of your time saying you are great or better.. Guess what you guys are worse. Your meaningless degree to do what ? be a cop ? Get real and look for a real job where you have reviews and are fired for cheaper labor overseas. Cops should say thanks for paying them and their pentions.     It is hard enough for the NYPD being tarnished by the actions of a drunk rapist and the two previous cops. The process to hire new cops is long and with an intensive background check. But some slip by all the interviews. So 30,000 or so officers are discredited. As to “Like it is’ letter which states,

    I am a Police Officer/Retired Military. I am also an American of Puerto Rican heritage.. Affirmative action may have played a role in my being hired but I do not think so. I hold a BS in Criminal Justice and perfect 4.0 average. (I work in the south at the will of the Sheriff) So you suggest as a minority I have an unsatiable sexual appetite. If you hire people who don’t know how to act and were never taught how to act by two parents what else can you expect? Reaise the standards and take only the best instead of the crud that has been hored the last ten years. If the Police Department allows sub standard hiring because of the lowered standards what else can the people of NYC expect than what it is now getting.

    Ron.B Your never know what a person will be until they do something such as this. Every cop as with every soldier takes a sworn oath. A bad cop is worse than the worst criminal in the world. So is a soldier. Why? Because they are sworn to uphold the law and protect us. We trust them with our lives. We obey the policmen’s every command. When they violate that trust and cross that line, they are the lowest of the low. I am glad that finally the brotherhood is recognizing this and not protecting them (at least more and more of them). I admire the police force in general and hold what I feel as a camaraderie among them as I spent 20 some years in the military for which there are a great deal of similarities in what we do. The majority of the nations police force uphold their oath in high esteem and reinforces it every day even though they face the low lives of our Country on a day to day basis.. Sadly those very, very few as with the military, ruin it for the majority. I for one will continue to hold in high esteem and respect our police and pray that I will never run into one of those that betray the people and their office and their fellow officers. The police along with the military’s unwavering brotherhood needs to lower the threshold of tolerance before it ecalates to the level of this crime. I think this is happening abeit ever so slowly,

      When i go for a “Perk Walk” it normally involves coffee, not a supposed rapist. The walks you refer to are done after the person is arrested at the police precinct and is going to a place where processing will be completed. It can take a day for that to happen, be patient.
