Woman Demands Arrest Of NYPD Officer Over September Pepper Spray IncidentBy Marcia Kramer

NEW YORK (CBSNewYork) — Next up for the “Occupy Wall Street protesters” are the courts.

Lawyers bombarded the Manhattan District Attorney’s Office Monday with a number of demands, including the charges against the hundreds arrested be dropped and called for the immediate arrest of the cop who used pepper spray, reports CBS 2’s Marcia Kramer.

The protesters will be “occupying” the courts in a very big way unless Manhattan DA Cy Vance agrees to drop all charges against the nearly 800 who have been arrested.

“We’re hoping to accomplish justice,” Martin Stolar said.

Protesters’ attorneys with aides to Vance will demand the dismissals, and if the DA balks they’ll occupy the courts by going to trial on each and every case.

“Given the nature of the arrests, the number of people who say, I’m not guilty of anything, I want a trial here, is likely to be very, very high,” Stolar told reporters. “We’re prepared to try every single case where somebody wants to have a trial, even if it’s only for blocking a roadway.”

The idea that the protesters would put pressure on the already overloaded court system didn’t sit well with Mayor Michael Bloomberg.

“I don’t think our court system should be a political football. It’s hard to reconcile that with what America stands for to say we’re going to deliberately keep the court system from working,” Bloomberg said.

Officials said everyone who wants a trial will get one.

“It’s the responsibility of the court system to take these cases and address them and give people their day in court,” said Officer of Court Administration David Bookstaver.

Meanwhile, attorney Ron Kuby and his client, Kaylee Dedrick, who was pepper sprayed by an NYPD deputy inspector, met with the DA’s office to demand that he be arrested. Back in September, a group of penned-in protesters were pepper sprayed . The incident was caught on video and prompted “Occupy Wall Street” protesters to march on One Police Plaza.

GRAPHIC CONTENT – Watch the pepper spray incident below:

Deputy Inspector Anthony Bologna is said to be the officer who used pepper spray on the women, who were already cordoned off by a mesh barrier in Union Square.

Bologna was given 24-hour protection at his Staten Island home after the hacker group “Anonymous” put out his name, personal details and a vague warning online that said in part “Before you commit atrocities against innocent people, think twice. WE ARE WATCHING!! EXPECT US!”

At the time of the incident, the NYPD said the pepper spray was properly used against people trying to interfere with police attempting to disperse a crowd.

The incident, however, is being eyed by the Civilian Complaint Review Board.

“The video tape on its face makes out a case for third-degree assault,” Kuby said.

A new Quinnipiac poll shows that the public is divided about how the NYPD is handling the protests:

* 46 percent say they approve of the NYPD’s actions

* 45 percent said they disapprove

So now the ball’s in the district attorney’s court. Vance still has to decide whether to indict a cop in the pepper spray case and whether to dismiss hundreds of cases against the protesters.

The cost of police overtime to deal with the protests is now $3.4 million, money the city says it could use for other things in these tough economic times.

At least two police officers were hospitalized this weekend, including one with a head injury.

Next up for the Occupy Wall Street protesters, a rally in solidarity with the “Granny Peace Brigade.” That group plans to hold a silent vigil at 7 p.m. Tuesday at the fountain in Lincoln Center.

The protesters have planned what they are calling a “National Day of Protest to Stop Police Brutality, Repression and the Criminalization of a Generation” next Saturday. The protest will begin at 2 p.m. at Union Square.

Do you think the officer should face charges? Sound off in our comments section below.

“I am here to celebrate the 30th day of this protest against corporate power,” said Karanja Gacuca from Liberty Square, a former Wall Street analyst who now organizes with Occupy Wall Street. “Concerned about the egregious Wall Street bonuses — particularly after the industry accepted a tax-payer bailout and the middle class continues to be squeezed — I believe it’s time for a fairer system that provides health care, education, and opportunity for all, and rejects corporate influence over government.”

You’re right. They’re ALL spoiled university students who can’t get mom & dad to pay the bills any more, and they totally have NO REASON to be there whatsoever.

It’s wrong when you can’t get the healthcare you need because of lack of funds.
It’s wrong when that genius kid from the bad side of town can’t become a doctor because they’d never be able to foot the bills.
And it’s wrong to stick a label on an entire movement of the people and try to sweep it under the rug.

They’re not all spoiled little yuppies, and there is a bigger problem at hand, here – do you really think thousands of people all over the world mobilized because they thought “oh hey, I think I’ll screw off from work today.”?

God, get your heads out of your a$$es.

PS – I’m a gainfully employed former university student who pays her own bills, before you start defaming me. Go from there.

Oh wow, thanks. Dad, is that you?!

No kidding, life’s not fair. Thanks for that. But it’s the job of those elected by the people to try and support their best interests in government, and in general that’s a big epic fail right now if this many people are dissatisfied with how things are running.

    1. Tea Party Rallies are single-day events, scheduled for weekends, because the Tea Partiers have jobs and family responsibilities.
    2. Tea Partiers bathe and could pass a drug test.

    3. Tea Party protest signs make sense and never contain the “F” word.

    4. Don’t expect to see the headline, “Tea Partiers Clash With Police.” anytime soon.

    5. Tea Partiers are asking the government to let them keep more of what they earned, as opposed to asking the government to give them more of what someone else earned.

    6. Tea Partiers can name their U.S. Senators and U.S. Representative.

    7. Tea Partiers leave the rally site cleaner than it was when they arrived. They don’t trash the place, and in fact pick up litter that was already there when they arrived.

    8. If you’re walking with your kids and stumble upon a Tea Party rally, you don’t have to cover your kids’ eyes and quickly lead them away.

    9. Tea Partiers aren’t living off their daddy’s credit card.

    10. Tea Party groups behave responsibly. They reimburse cities for any electricity they use. They don’t stay longer than a few hours or cause any trouble so there’s no massive taxpayer expenses for police overtime. Nor do they vandalize the area, requiring taxpayers to clean the mess up later.

Bonus eleventh difference between the Tea Partiers and the Occupiers:

Despite numbers one through ten above, the media and the Democrats assure us that the Tea Partiers are dangerous, ignorant, violent radicals, while the Occupiers are our best and brightest.

    3. Anon E. Muss says:

In a case of police brutality, the cause is not the issue. There are only two questions that we need to ask:

      1. What did the women who were sprayed do to meet the conditions that warrant pepper spraying under NYPD patrol guide section 212-95?

      2. Were the spraying officer’s actions consistent with section 212-95?

Their cause, their beliefs, whether they were dirty stinky hippies or upstanding constitution-defending tea-partiers is irrelevant. The only issue is whether the officer’s actions in this instance were justified.

Note to Cyrus aVance Jr.: do the right thing – no settlements, no plea deals, no dismissals. If they want trials, oblige them.
These snot nosed little punks committed criems – some misdemanors, some felonies – and were arrested; let them go through the system like any other citizen. They should thank their lucky stars they live in a democracy where the worst that can can happen is to be arrested – if they were in Syria, they would be in an unmarked grave within a day of being arrested.
Take your protest to Washington, where it belongs, and stop messing with the lives of ordinary New Yorkers. When you do so, don’t expect the DC Metro or US Capital Police to be as lenient as the NYPD any Mayor Bloomberg have been.

I feel i should comment on the silly “forgive student loan” petition that is circulating now on the internet: How do you propose we “forgive” student loans? Having the feds pay them off at a cost of around 1 trillion (that we do not have and would need to be covered by taxes)? Or maybe force banks and financial institutions to just wipe them off their books? If the latter were to happen, interest rates would be risen to offset their loss as well as credit card rates and bank fees. Then we would have even more economic problems for us “non students” (who, by the way, paid off our own loans at great difficulty years ago). No, this is just another idea from children that was not thought out or at least, not understood. Keep trying though, any idea is a good one as long as we keep trying.

UNBELIEVABLE!!

Let the Occupy folks waste their “donated” money in court fees! Charge them double and see how that works out for them. I bet their parents will get tired of footing their daily bills quickly at that rate! They should put their efforts to better use, like delivering food for City Harvest, building for Habitat or being Big Brothers/Sisters to kids who need them. It’s a shame that they feel they have gotten so “big” that they can threaten the legal system too! Egos go home!

    1. Michael H. says:

Why charge them double? Are you proposing a separate and unequal judicial system for the #OWS protesters? How is that American in any way shape or form?

  14. Jerry Frey says:

An unscripted reality show, Occupy America is a populist movement in the tradtion of the nineteenth century Cross of Gold. Speculation (George Soros; hedge funds), long or short, oil futures, de-regulation, neo-liberalism, benefits the 1 percent connected class with no social benefit. Banks once organized and allocated capital in order to produce wealth, economic expansion, that benefited the many rather than the few. Globalists know no national loyalty and are detached from their nations.

Get the $oney out of politics. Campaign contributions are the nexus of corruption in the capitol. Reduce the amount of money involved in re-election, which really is the name of the game, by promulgating free air time during elections. Keep the current system for primaries.

History repeats itself: no leadership, no vision, no perspective, chickens have come home to roost…Selfishness.

For example, there was an imbalance in trade between the Western and Eastern halves of the Roman Empire, along with high taxation. Consider: the government lost control of its borders — Goths, Franks, Suevi, Alans — and society experienced moral decay.

NeilSalemMA Why does all this remind me of France in the 1780s and 1790s?

    1) 1780s – The economy of France is in crisis. The civil population is poor and becoming poorer and they are starving.
    2) 1789 – The storming of the Bastille – the revolution begins
    3) 1791 – The King and Queen flee for their safety.
    4) 1792 – The King and Queen are arrested.
    5) 1793 – The guillotine – King Louis XVI and Queen Marie Antoinette are beheaded.
    6) 1793 – 1794 – the Reign of Terror. Over 16,000 people are beheaded.

Our system of free enterprise is a corrupt oligarchy of the wealthy that drives more and more middle class Americans into poverty, even while the very rich get much richer. As happened over 200 years ago in France, the people will eventually rise up.

  15. Flynn says:

Once again the conservative/Tea Party cronies crawl out with their “If you’re not with us, you’re against us” rhetoric. News flash, porkchops: you may not like what these people are saying, but they have as much right to march, protest or whatever the heck they want to do as a bunch of morons dressed up as Revolutionary War soldiers with tea bags dangling from their hats have.

You don’t like to hear what they have to say? Then ignore it. I’m sure that’s not hard for you to do — just turn the volume up on Fox News and fill your head with more truthiness.

    1. kenny says:

Excellent. “Tea Party Know It All’s” have had their time. Most people are sick and tired of their spoiled child whining. OWS share the anger of real ordinary Americans, not the privileged few.

You are WRONG! They think they represent the real ordinary Americans. They actually only represent the spoiled few.

I am not certain on where this whole movement is heading. However, I would be thrilled to see the protestors demand answers to:
      1) College tuition – why does it increase TWICE AS FAST as inflation? This is a joke (and I’m surprised that no one in the government really complains about this).
      2) Unless you’re lucky enough to be “Mr. Junk Bond” up here (like Mr. Goldman Sachs VP. . .whose parents might have been rich enough to send him/her to some snooty boarding school), why the government is hell-bent on spending on foreign wars, sending money to Israel and Egypt, while some people here are starving. 21. Reality speaks says:

The problem with all the video taping being done there is that when it hits the airwaves only the some part of an incident is being shown, not what led up to it. Like in the case of the Lt. who was caught swinging his batton at a crowd, the video never showed that the crowd chraged him. It is all about the editing & making the cops look wrong while dealing with these professional demonstrators & anarchests.

    1. New Yorker Here says:

Yes he was swiping but the crowd never touched him. also his wild swing could have injuried his owb men.

    1. NYPD some New Yorkers still care says:

You do not see all in the video just the parts the protesters want us to see.The police have a tough enough job with terroist now this protest is making NYC weak for a attack.Very sad noone knows what there cause is and how to stop it.

      1. Michael H. says:

The NYPD has their own video cameras taping all of these incidents. If the protester’s videos are not showing the whole story, where are the videos from the other side? Why have the NYPD videos not been released? What are they hiding?

        1. Phyllis says:

Maybe the NYPD is waiting to be able to submit their videos as evidence at trial rather than create pre-trial bias by showing only a portion of the events as the OWS (“Only Wasting Space”) crowd are doing.

        2. A.R says:

Yes, this is the interresting point you make.

    2. Jduzit Tha Artist says:

I agree with you teacher. The people replying here must be those who live up in the condos and luxury lofts overlooking central park, with no clue what so ever is truly happening on the grounds of the city (ie wall st!)

      1. Phyllis says:

Interesting you think it’s OK to say that about me – you did state “the people replying here” which means you think that you know me.

Frankly you don’t. Don’t assume you know where I live or how. When we all decide to stop vilifying each other and demonize one group vs. another than maybe we can make real headway. Until them OWS (Only Wasting Space) is just that…

  23. clarence says:

So what is wrong with using pepper spray with a crowd that is being confrontational, spitting and swearing at you. I happily support the inspector who peppered sprayed them.

      1. Good for the NYPD says:

If my kid was down there “protesting”, he deserves to get sprayed. He better be at work, not parading about like an imbicile.

        1. Anon E. Muss says:

“At work”? The incident took place on September 24th, a Saturday.

    4. Anon E. Muss says:

It was wrong because 1. We don’t know if they were spitting, there were no reports of that.

      2. Words, no matter how offensive or loud, do not justify pepper spray under NYPD patrol guide section 212-95

      3. NYPD patrol guide section 212-95 states that pepper spray should only be used on those who are violently resisting or represent a physical threat.

      4. The cameras were on those four women for a good 20 seconds prior to the spraying, and there was no indication that they were a physical threat.

      5. According to section 212-95, once someone has been sprayed, it is required that they be arrested, provided with medical assistance, sat in the proper position to allow for easy breathing, and asked if they are wearing contact lenses.

      6. The officer in question did none of the above, the four women’s actions met none of the above conditions that could justify pepper spray, and then he simply walked away. There was nothing about this incident consistent with section 212-95. Therefore he violated his own official code of conduct and should be punished as such.

  24. JD says:

Yes, the police should be prosecuted first they lied to protect their own as usual, and then they find out the real truth because someone videotape the incident ,if the police dont have nothing to hide why are they stopping ppeople from using their cameras ,are in the Soviet union or Russia where democracy exist only in word.I am for law and order but people have a right to protest injustices when it happened the cops as individual also enjoy the fruits. This white shirt police official should be out of his job and go work for private security firm.

  25. New Yorker Here says:

I had to see this for myself so I went down on the 14th of Oct. and took the lead in a peaceful march to City Hall. All I can say is that the police were nice and walked along side of us only until we close to City Hall then the riots cops came but for no reason we just marched around and then headed back to Liberty Park. Now from what I have seem the police that do throw the 1st punch or pepper spray are the older officers in the white shirts (the ones that are never really patrolling and in the office) they tend to panic while the everyday street cop knows how to avoid confrontation. All the police have to do is let them march give them room and it will be over quickly. Also speaking with friends in the NYPD many are actually for this because they are affected as well just look at what they get paid for a major city like NY as was told by 3 friends of mine in the NYPD. We are all affected in one way but if you’re going cry about the cost of living, healthcare, education and bank screwing us then this is your chance to speak out. This was a very long time coming before Obama before Bush and many more …. Peace and one love

PS; I am not from any other state and from NYC born and raise (50yrs

    4) Blast it out on the Internet screaming “POLICE BRUTALITY!”

problems. WHAT would Happen IF the real Right Wing Extremists took matters in
their Own Hands, and Went up against these Socialist Fools in Public.? There
would be Riots in the Streets and the Elites who are running things behind the
closed doors would use this to declare Martial Law on the rest of us. Who is going to Stand Up to This Farce and Charade to put a stop to this ? Very Interesting this all started a Week after Obama’s Speech about Coming Together.
It is Just doing the Opposite and making the U.S. the laughing stock of the World.
Put a stop to this Communist Agenda Now. When 2012 comes around. THROW
Them ALL Out of Office who is backed by the Teleprompter in Chief. GET rid of the Damn Phnony Czars and the Useless Assistants they have now.

The video doesn’t lie. He pepper sprayed them for no reasons. They were peaceful and doesn’t posed any harm. Hey, we are for police too but this is way out of bounds to be pepper spraying them.

    1. video was edited says:

      video was edited

      1. Anon E. Muss says:

        Then show us the original.

Actually, there are videos of the scene from multiple angles. If the famous one was edited, then the other videos should show something else happening, right? They shouldn’t line up perfectly, right? Except they all show the same thing, and they all line up perfectly. If they were all edited, it must have been a professional. It is much easier to assume that they were not edited.

    2. A,R, says:

A strong man spraying poor women for no reason. This WHIMP should work in the sanitation dept. not in the police force.

  30. Excessive Force says:

The girls were behind the barrier and there were no reason for the Police to use pepper spray.

    1. Michael H. says:

Precisely. What threat did these women pose to Inspector Bologna and his officers that he felt it necessary to use pepper spray to subdue them? They were behind a crowd control barrier with no weapons. This is a prime example of police brutality and I hope that Inspector Bologna loses his shield because of it.

      1. no spitting says:

Spitting at a police officer is a no no .Or did your parents not teach you manners Michael H

        1. A New Truth says:

        2. Michael H. says:

Where is the proof that this woman spit at Inspector Bologna? This is the first I am hearing of this.

      2. Sam says:

I don’t believe the cops used excessive force at all. These women were inciting bad behavior. Yes spitting at a police officer is a big no no. If someone spit at me I would do more than pepper spray them

        1. Jduzit Tha Artist says:

Sounds like those girls have more heart than you sissy Sam!

        2. A,R, says:

What proof of spitting is there? You protect a WHIMP police official. Are there no more MEN in this society? How a real MAN can say that this WHIMP in the white shirt did the right thing? This white shirt WHIMP should be kicked OUT of the NYC police force for his own good. Let him spray his own wife. He, he. What a WHIMP.
