Prosecutors: NYC Teacher Had Sex With Female Student In Classroom, Car

NEW YORK (CBSNewYork) -- A married New York City teacher was arrested Thursday for allegedly having an affair with a teen student. Prosecutors said the teacher even had sex with the girl in his classroom and that the accused man's wife had a role in the investigation.

Charles Oross, a 44-year-old social studies teacher at IS 238 in Queens, was arrested on charges of having sex with a female student who was 13 years old at the time. Prosecutors said the relationship continued for more than a year -- from January 2009 to April 2010 -- on school property and in Oross' car.

Oross, of East Islip, has been charged with statutory rape, criminal sexual act and endangering the welfare of a child, 1010 WINS' Terry Sheridan reported. Oross is accused of having sex with the girl in her last year at the Susan B. Anthony School, with the relationship allegedly continuing when she went to high school.

"It started back in January of '09 when the girl was 13 years old and she started to meet the teacher, Charles Oross, at school every morning at 6 a.m., and they started to have sexual relations," Special Investigations Commissioner Richard Condon told CBS 2's Pablo Guzman.

Oross and the girl had sex in the classroom "probably from January to March of '09," according to Condon.

The relationship lasted for months and ended when the girl, now in high school, began dating another student.  However, investigators said after Facebook communications and e-mails from Oross, the two got back together again.

"In high school, the relationship was more he would meet her with his car and they would have sexual relations in his car," Condon said.

According to the investigative report, car sex happened on 10 to 14 occasions after Oross "drove to a secluded location."  Later that year, the girl wanted to start "hanging out" with friends her own age.  Oross  was angered with the suggestion and the two broke up, CBS 2's Sean Hennessey reported.

Then months later, the girl received more Facebook communications -- with a twist.

"It turned out they were not from him, they were from his wife. You know, e-mailing as if she were the husband," Condon said.

The student told Oross' wife the two had sex and she called investigators and told them her husband admitted he had a sexual relationship with a student.

Parents of students at IS 238 were in disbelief upon hearing the news.

"I feel bad about it, because I didn't know about it. I feel shock because I have my son over here and that school has good reputation for a long time," one woman said.

"It's terribly disturbing when you see these kinds of things occur, and as a result, we vigorously prosecute these kinds of cases," Queens District Attorney Richard Brown said.

Oross faces up to four years in prison if convicted and is currently being held pending arraignment in Queens Criminal Court.

"At this point, it's only an allegation. Nothing has been proven in court and we intend to fight the case," defense attorney Donald Vogelman said.
