NEW YORK (CBSNewYork/AP) – Actress Lindsay Lohan claimed that she was assaulted by a man she met while partying at the W Hotel on Park Avenue South, according to published reports.
According to the Daily News, Lohan and friends met Christian LaBella, 25, of California while partying at the trendy club 1Oak. LaBella works for Republican John Shimkus of Illinois, according to the Daily News. A spokesperson for his employer told the Daily News in an email that he was not happy about LaBella’s alleged involvement in the incident.

“While no one from Congreesman Shimkus’ office has been contacted by Mr. LaBella following his arrest, he has been an employee in the Congressman’s Washington office,” the email read, “Obviously the Congressman does not condone his actions.”
Lohan, 26, reportedly became enraged when LaBella allegedly began snapping cell phone pictures of the troubled actress.
Lohan’s father Michael told the Post LaBella tried to choke Lindsay.
“The guy apparently grabbed her by the throat,” Lohan told the Post. “He came up from behind and choked her.”READ MORE: Small Plane Makes Emergency Landing On Fire Island Beach
Police confirmed to 1010 WINS that LaBella was arrested Sunday morning at the W Hotel Union Square and charged with assault and harassment.
Those charges were later dropped, and his arrest voided, a law enforcement source told 1010 WINS.
Afterward, Lohan publicist Steve Honig expressed outrage that police did not charge LaBella.
“We think it’s both distressing and outrageous,” he said in a telephone interview. “Lindsey was assaulted and there needs to be a consequence for that.”
Both parties have filed harassment complaints against each other.
Earlier this month, Lohan was arrested near the Dream Hotel in Chelsea for allegedly clipping a pedestrian with her car. She is still on informal probation for stealing a necklace from a jewelry store last year.
