Police: Man Who Fell Onto Third Rail On LIRR Tracks Was Attacked

NEW YORK (CBSNewYork) -- Early reports said a man who fell onto the third rail and died at the Bellmore Long Island Rail Road station had suffered a seizure, but police said Saturday evening that he was attacked.

A suspect has been arrested in connection with the incident.

The 49-year-old Freeport man fell onto to the tracks and came into contact with the third rail sometime before 5 a.m., Nassau County police said.

The initial call to 911 operators indicated that the man likely suffered a seizure, police said.

But investigators later concluded that the man had gotten into a quarrel with someone that turned into a physical fight, police said.

A 34-year-old man from the Nassau County hamlet of Roosevelt has been arrested and charged Saturday, police said. Niheim Levy was charged with felony murder and robbery for his alleged role in the event.

The Nassau County and Metropolitan Transportation Authority police departments continued to investigate the incident Saturday evening.
