Jimmy McMillan Of 'Rent Is Too Damn High' Fame Says He's Facing Eviction Again

NEW YORK (CBSNewYork/AP) -- Jimmy McMillan, the man who has become famous for making his political name over the claim that ``the rent is too damn high,'' said Tuesday that he is running the risk of losing his place to live.

Jimmy McMillan says he is facing an eviction notice that says he has to leave his rent-stabilized apartment on St. Mark's Place in the East Village which he has rented since the late 1970s.

McMillan, who spiraled to national fame following a wild gubernatorial debate in 2010, filed papers in U.S. District Court in Brooklyn seeking a stay of the eviction notice.

His attorney has filed with an appeals court as well, seeking a stay of the eviction order.

McMillan says his landlord wants him out to be able to charge market rent to someone else. He says he pays $872.96 per month.

A call to the landlord company and an email to its attorneys were not answered.

McMillan said he was also faced with possible eviction back in 2011. At that time, Lisco Holdings, the building's owner, said in court papers McMillan violated his lease agreement because he actually lived in Brooklyn, according to the Post. As per rent-controlled rules, the East Village apartment should be his primary residence.

At the time, McMillan's son lived at the apartment on St. Mark's Place, and McMillan said he also used it as his office.
