No Grand Jury Charges In 2011 Shooting Of Cabbie By Off-Duty Nassau County Police Officer

YAPHANK, N.Y. (CBSNewYork/AP) -- A special grand jury convened to investigate the shooting of an unarmed cab driver by an off-duty Nassau County police officer expired with no charges brought.

Newsday reports it interviewed seven central figures or lawyers in the Feb. 2011 Huntington Station incident and all said they hadn't been asked to testify before the grand jury.

Robert Clifford, a spokesman for Suffolk County District Attorney Thomas Spota, confirmed Newsday's findings, the newspaper reported. Clifford acknowledged Spota allowed the grand jury to expire last year without key witnesses being called. He wouldn't say whether the grand jury called any witnesses.

Prosecutors were thwarted at every turn in its attempt to move forward, Clifford said.

Officer Anthony DiLeonardo shot and injured the cabbie after a night of drinking, authorities said.

Officials determined DiLeonardo shot at cabbie Thomas Moroughan five times, striking him twice. An internal investigation concluded DiLeonardo unlawfully shot the cab driver.

Moroughan survived his injuries and filed a $30 million civil suit. He was initially charged following the incident, but the charges were subsequently dropped.

DiLeonardo was fired last year.
