Man Accused In Fatal Stabbing Suing NYC Transit Authority After Alleged Fall In Front Of Train

NEW YORK (CBSNewYork/AP) -- A former NYPD officer charged in the ambush killing of his ex-girlfriend in New Jersey is suing New York City's transit authority for $50 million.

Attorney Andrew Plasse said his client, Arthur Lomando, was seriously injured when he fell from the platform of the 168th Street station following the killing.

Plasse claimed Lomando was jostled and that the station was overcrowded. In documents filed in New York, Plasse said Lomando either slipped or was hit by falling debris.

Lomando had both feet amputated as a result of his injuries.

But police had said Lomando tried to kill himself by jumping in front of a subway train on Oct. 22, hours after he allegedly stabbed Suzanne Bardzell to death with a machete-like knife.

Authorities said Lomando confronted Bardzell in her driveway, broke her left window and then attacked her, striking her several times with the knife.

Bardzell, a special education teacher with two teenage sons, died at the scene. Bergen County Prosecutor John Molinelli said the murder weapon was left inside the vehicle.

Prosecutors said Bardzell dated Lomando for three years after meeting online. They said prior to the stabbing, she had taken out a restraining order against him after a history of domestic violence.

Lomando is expected in court Friday for a hearing on the murder charge.
