New Jersey Actor Could Face Jail Time After Using Prop Gun While Filming

WOODBRIDGE, N.J. (CBSNewYork) -- A New Jersey actor's movie role could land him in prison.

Actor and comedian Carlo Bellario is facing five plus years in prison for using what he thought was a prop gun while filming a movie in Middlesex County.

"I'm waiting for Ashton Kutcher to jump out and say this is definitely a 'Punk'd' scene," Bellario told CBS2's Meg Baker.

Bellario has performed at shows with comedy legends like Tracy Morgan, Don Rickles, and Joan Rivers. He's acted as an extra in CBS Shows "Blue Bloods," "The Good Wife," and "Elementary."

He said this last gig with EPYX Productions was anything but professional. He was cast as a body guard in a simulated car chase with guns, shot on Bucknell Avenue in Woodbridge.

"I held my hand out the window and I didn't fire anything... they were going to dub in the sound," Bellario said.

The actor said the scene inside the car took no more than five minutes, but neighbors who had no idea what was going on were frightened and called police.

"We get back, we are surrounded by cop cars. Apparently neighbors and residents saw this and called the cops and rightly so," Bellario said.

He was arrested on the spot and spent four nights in jail. He was released on $10,000 bail.

The production company did not have a permit to shoot the film or for the air soft pellet gun Bellario was holding.

"George Clooney doesn't show up on a set and ask Martin Scorsese, 'Hey Marty, do you have all your permits?' As an actor you go there, do what you are supposed to do and leave," Bellario told CBS2.

Neighbors on the block say they hope the system treats Bellario fairly.

"You never know who is actually in a car... unfortunate it was the actor, they should release him," Nicole Hrabkoabsky, a Woodbridge resident, told CBS2.

Bellario said he took the role for no money, and now it's costing him big time to deal with the aftermath. He was arrested and charged with weapons possession.

The case is currently being investigated by the Middlesex prosecutor's office.
