Sources: NYPD Officer Indicted In July 4 Shooting That Killed Man In Brooklyn

NEW YORK (CBSNewYork) -- An NYPD officer has been indicted in a shooting that killed a man in Brooklyn this past summer, sources said Monday.

Sources told CBS2 that Wayne Isaacs was indicted in the shooting that killed Delrawn Small, 37, on July 4.

Small was shot by Isaacs when the officer was off duty, after allegedly getting into a quarrel while at a traffic light in Brooklyn shortly after midnight on July 4.

Small was shot in front of his wife and two children. Family members said Small was with his girlfriend and children celebrating the holiday when they stopped at a friend's barber shop on Atlantic Avenue in Brooklyn.

Based on a preliminary investigation during the summer, police initially said they believed Isaacs opened fire after Small reached through the officer's open window and repeatedly hit him in the head as he sat behind the wheel.

However, video of the attack sparked a dispute on what really happened.

In the grainy black-and-white video, virtually the moment Small walks up to the window, he recoils, stumbles and collapses, with no clear indication that he first lashed out at the officer. The officer briefly exits his car and looks in the fallen man's direction but then returns to the car.

Attorney General Eric Schneiderman said over the summer that he had met with the family to express his condolences and explain his role as special prosecutor on the case.
