Woman Demands Arrest Of NYPD Officer Over September Pepper Spray Incident

NEW YORK (CBSNewYork) — Next up for the “Occupy Wall Street protesters” are the courts.

Lawyers bombarded the Manhattan District Attorney’s Office Monday with a number of demands, including the charges against the hundreds arrested be dropped and called for the immediate arrest of the cop who used pepper spray, reports CBS 2’s Marcia Kramer.

The protesters will be “occupying” the courts in a very big way unless Manhattan DA Cy Vance agrees to drop all charges against the nearly 800 who have been arrested.

“We’re hoping to accomplish justice,” Martin Stolar said.

Protesters’ attorneys with aides to Vance will demand the dismissals, and if the DA balks they’ll occupy the courts by going to trial on each and every case.

“Given the nature of the arrests, the number of people who say, I’m not guilty of anything, I want a trial here, is likely to be very, very high,” Stolar told reporters. “We’re prepared to try every single case where somebody wants to have a trial, even if it’s only for blocking a roadway.”

The idea that the protesters would put pressure on the already overloaded court system didn’t sit well with Mayor Michael Bloomberg.

“I don’t think our court system should be a political football. It’s hard to reconcile that with what America stands for to say we’re going to deliberately keep the court system from working,” Bloomberg said.

Officials said everyone who wants a trial will get one.

“It’s the responsibility of the court system to take these cases and address them and give people their day in court,” said Officer of Court Administration David Bookstaver.

Meanwhile, attorney Ron Kuby and his client, Kaylee Dedrick, who was pepper sprayed by an NYPD deputy inspector, met with the DA’s office to demand that he be arrested. Back in September, a group of penned-in protesters were pepper sprayed . The incident was caught on video and prompted “Occupy Wall Street” protesters to march on One Police Plaza.

Deputy Inspector Anthony Bologna is said to be the officer who used pepper spray on the women, who were already cordoned off by a mesh barrier in Union Square.

Bologna was given 24-hour protection at his Staten Island home after the hacker group “Anonymous” put out his name, personal details and a vague warning online that said in part “Before you commit atrocities against innocent people, think twice. WE ARE WATCHING!! EXPECT US!”

At the time of the incident, the NYPD said the pepper spray was properly used against people trying to interfere with police attempting to disperse a crowd.

The incident, however, is being eyed by the Civilian Complaint Review Board.

“The video tape on its face makes out a case for third-degree assault,” Kuby said.

A new Quinnipiac poll shows that the public is divided about how the NYPD is handling the protests:

* 46 percent say they approve of the NYPD’s actions

* 45 percent said they disapprove

So now the ball’s in the district attorney’s court. Vance still has to decide whether to indict a cop in the pepper spray case and whether to dismiss hundreds of cases against the protesters.

The cost of police overtime to deal with the protests is now $3.4 million, money the city says it could use for other things in these tough economic times.

At least two police officers were hospitalized this weekend, including one with a head injury.

Next up for the Occupy Wall Street protesters, a rally in solidarity with the “Granny Peace Brigade.” That group plans to hold a silent vigil at 7 p.m. Tuesday at the fountain in Lincoln Center.

The protesters have planned what they are calling a “National Day of Protest to Stop Police Brutality, Repression and the Criminalization of a Generation” next Saturday. The protest will begin at 2 p.m. at Union Square.

    It’s wrong when you can’t get the healthcare you need because of lack of funds.
    It’s wrong when that genius kid from the bad side of town can’t become a doctor because they’d never be able to foot the bills.
    And it’s wrong to stick a label on an entire movement of the people and try to sweep it under the rug.

    They’re not all spoiled little yuppies, and there is a bigger problem at hand, here – do you really think thousands of people all over the world mobilized because they thought “oh hey, I think I’ll screw off from work today.”?

    9. Tea Partiers aren’t living off their daddy’s credit card.

    10. Tea Party groups behave responsibly. They reimburse cities for any electricity they use. They don’t stay longer than a few hours or cause any trouble so there’s no massive taxpayer expenses for police overtime. Nor do they vandalize the area, requiring taxpayers to clean the mess up later.

    Bonus eleventh difference between the Tea Partiers and the Occupiers:

    Despite numbers one through ten above, the media and the Democrats assure us that the Tea Partiers are dangerous, ignorant, violent radicals, while the Occupiers are our best and brightest.

      In a case of police brutality, the cause is not the issue. There are only two questions that we need to ask:

      1. What did the women who were sprayed do to meet the conditions that warrant pepper spraying under NYPD patrol guide section 212-95?

      2. Were the spraying officer’s actions consistent with section 212-95?

      Their cause, their beliefs, whether they were dirty stinky hippies or upstanding constitution-defending tea-partiers is irrelevant. The only issue is whether the officer’s actions in this instance were justified.

    I feel i should comment on the silly “forgive student loan” petition that is circulating now on the internet: How do you propose we “forgive” student loans? Having the feds pay them off at a cost of around 1 trillion (that we do not have and would need to be covered by taxes)? Or maybe force banks and financial institutions to just wipe them off their books? If the latter were to happen, interest rates would be risen to offset their loss as well as credit card rates and bank fees. Then we would have even more economic problems for us “non students” (who, by the way, paid off our own loans at great difficulty years ago). No, this is just another idea from children that was not thought out or at least, not understood. Keep trying though, any idea is a good one as long as we keep trying.

    The problem with all the video taping being done there is that when it hits the airwaves only the some part of an incident is being shown, not what led up to it. Like in the case of the Lt. who was caught swinging his batton at a crowd, the video never showed that the crowd chraged him.       It was wrong because 1. We don’t know if they were spitting, there were no reports of that.

      2. Words, no matter how offensive or loud, do not justify pepper spray under NYPD patrol guide section 212-95

      3. NYPD patrol guide section 212-95 states that pepper spray should only be used on those who are violently resisting or represent a physical threat.

      4. The cameras were on those four women for a good 20 seconds prior to the spraying, and there was no indication that they were a physical threat.

      5. According to section 212-95, once someone has been sprayed, it is required that they be arrested, provided with medical assistance, sat in the proper position to allow for easy breathing, and asked if they are wearing contact lenses.

      6. The officer in question did none of the above, the four women’s actions met none of the above conditions that could justify pepper spray, and then he simply walked away. There was nothing about this incident consistent with section 212-95. Therefore he violated his own official code of conduct and should be punished as such.

    I had to see this for myself so I went down on the 14th of Oct. and took the lead in a peaceful march to City Hall. All I can say is that the police were nice and walked along side of us only until we close to City Hall then the riots cops came but for no reason we just marched around and then headed back to Liberty Park. Now from what I have seem the police that do throw the 1st punch or pepper spray are the older officers in the white shirts (the ones that are never really patrolling and in the office) they tend to panic while the everyday street cop knows how to avoid confrontation. All the police have to do is let them march give them room and it will be over quickly. Also speaking with friends in the NYPD many are actually for this because they are affected as well just look at what they get paid for a major city like NY as was told by 3 friends of mine in the NYPD. We are all affected in one way but if you’re going cry about the cost of living, healthcare, education and bank screwing us then this is your chance to speak out. This was a very long time coming before Obama before Bush and many more …. Peace and one love

        Actually, there are videos of the scene from multiple angles. If the famous one was edited, then the other videos should show something else happening, right? They shouldn’t line up perfectly, right? Except they all show the same thing, and they all line up perfectly. If they were all edited, it must have been a professional. It is much easier to assume that they were not edited.

      Precisely. What threat did these women pose to Inspector Bologna and his officers that he felt it necessary to use pepper spray to subdue them? They were behind a crowd control barrier with no weapons. This is a prime example of police brutality and I hope that Inspector Bologna loses his shield because of it.
