NEW YORK (CBSNewYork) – The postal truck driver who was accused in a hit-and-run accident that left a Manhattan woman dead has been acquitted by the jury.
Ian Clement, 63, faced a single charge of leaving the scene of a fatal accident after he struck Marilyn Dershowitz as she rode her bicycle along West 29th Street near a busy postal depot on July 2, 2011.

Clement had testified that he felt a bump and heard cars honking their horns, but did not get out of his truck before driving off. The defense had argued that Clement was unaware that he hit anybody.
Dershowitz, 68, was crushed by the back wheels of the seven-ton postal truck and later died at Bellevue Hospital.
After the not guilty verdict was handed down, Clement expressed relief and his sympathy for the Dershowitz family, WCBS 880’s Irene Cornell reported.
Dershowitz’s husband Nathan, who is a lawyer, said after the verdict that he believes in the jury system but wished he had been part of the prosecution team, Cornell reported.
Defense attorney John Arlia argued that the case would have never gone to trial if Dershowitz was not the sister-in-law of famed attorney Alan Dershowitz.
