Family Of Bodega Worker Accidentally Killed By Police To Sue City

NEW YORK (CBSNewYork/AP) -- The family of a bodega worker who was accidentally shot and killed by a New York City police officer during a robbery plans to sue the city for $25 million.

Surveillance video showed that the fatal shot happened when the two men collided. The NYPD has said the shooting was accidental.

But an attorney for the Cuevas family says the officer acted recklessly and carelessly with his weapon.

Civil rights attorney Sanford Rubenstein said Saturday that he will file a $25 million claim against the city on Monday.

On Saturday, relatives of the slain man planned to march from the spot where the killing happened to a neighborhood police station.

Despite the Bronx district attorney promising an independent investigation, Cuevas' family also demanded a grand jury to investigate what happened.

Reynaldo Cuevas' own father died from gun violence in the Dominican Republic. He was shot two years ago by robbers trying to take his gold chain, 1010 WINS' Sonia Rincon reported.
