L.I. Man Suing Nassau County Police, Others Over 'False Arrest'
HEMPSTEAD, N.Y. (CBSNewYork) -- A Westbury businessman has filed a federal civil rights complaint against Nassau County, the police department and the district attorney's office charging that he was falsely arrested two years ago.
Roy Tuccillo claims Richard Tobin, the personal auto mechanic of Police Chief John Capece, threatened him and tried to run him over during a road rage incident in June 2011.
"While going to dinner I was a victim of an out-of-control driver who threatened me verbally and physically," Tuccilo said.

Tuccillo claims Tobin called the police chief and got him arrested.
"The humiliation that I went through that night was disgraceful," Tuccillo said.
Tuccillo's attorney Fred Brewington called the incident a blatant case of abuse of power, WCBS 880's Mike Xirinachs reported.
"They are bullies and I've learned a lot about the system and it's pretty scary," Tuccillo said. "I think the whole system is corrupt."
Charges against Tuccillo were eventually dropped.

"I did nothing to this man yet he tried to hit me with his car and called on his personal relationship with Detective John Capece to have me arrested and dragged through the court system for nearly two years based on lies and false charges," Tuccillo said.
He is seeking $12 million, 1010 WINS' Mona Rivera reported.
Speaking to Newsday, Nassau County Attorney John Ciampoli said his office plans to defend the county "vigorously." A Nassau County police spokesman told the newspaper that the department would have looked into Tuccillo's arrest if someone had filed a complaint, but no one did.
