Police: LI Man Drives Drunk, Uses Cell Phone With Teen In Car

HEMPSTEAD, N.Y. (CBSNewYork) -- A Long Island man has been arrested after allegedly driving drunk in a car that was not his, with a 14-year-old in the passenger seat.

Jhordy Melendez, of New Cassel, was stopped after police noticed he was using his cell phone while driving a 2009 Nissan Rogue down Fulton Avenue in Hempstead at around 4:10 a.m, police said.

Melendez was arrested after police noticed he smelled like alcohol, police said. Further police investigation revealed Melendez was also driving the vehicle he was pulled over in without permission from the owner.

A 14-year-old boy in the passenger seat was released to a family friend following the arrest.

Melendez is expected to be arraigned Wednesday in Hempstead.
