A ban on outdoor smoking in New York parks was upheld Wednesday by a midlevel court, reversing a judge and dismissing a challenge filed by a smokers’ rights group.
The New York State Office of Parks, Recreation and Historic Preservation is cutting the cost of its 3-year Empire Passport to $130 on Monday.
State Supreme Court Justice George Ceresia said the February rules establishing no-smoking areas at various parks isn’t supported by any policy set by the Legislature.
Parks officials say that will protect children and others from the dangers of secondhand smoke and reduce litter from discarded cigarettes.
