RIVERHEAD, N.Y. (CBSNewYork/AP) — A state appellate court has upheld the murder conviction of a New York man who shot and killed a man with a bow and arrow.
The state Court of Appeals on Tuesday rejected Thomas Sirico’s argument that he was too intoxicated at the time of the shooting to be held responsible.
Sirico acknowledged he acted carelessly on the night of Jan. 8, 2006, when he shot Juan Carlos “Angel” Munoz. But he argued he should have been convicted of a lesser charge, not murder.
Prosecutors said Sirico was drinking and arguing with a roommate on the day of the slaying. Munoz was across the street at a neighbor’s house in Mastic when Sirico suspected he made a wisecrack and fired at him.
The 39-year-old is serving 25 years to life in prison.
