Custody Battle Over Children Of Slain Boonton Mother Remains Unresolved

NEW YORK (CBSNewYork) -- The fate of two young boys, whose mother was gunned down on a New Jersey street, remains up in the air after a judge tabled a battle over their custody.

Family members of Nazish Noorani, who was shot and killed in August while walking down a Boonton street, had sought to get custody of slain woman's two kids, ages 5 and 3.

However, a judge granted them only visitation rights while pushing back a custody ruling for three weeks.

Noorani's husband, Kashif Parvaiz, the father of the boys, has been charged in Noorani's murder along with his alleged mistress, Antionette Stephen.

Noorani's relatives insisted they are better suited to care for the children and that they should not be in the hands of her alleged killer's loved ones, 1010 WINS' Steve Sandberg reported.

Last week, a chilling 911 call was released in which Parvaiz sounded panicked and, at times, inaudible as he gasped and shouted into the phone at the dispatcher just moments after his wife was shot dead.

Parvaiz sustained gunshot wounds to the shoulder and foot in the August 16 shooting. Noorani, who was shot multiple times in the chest, was pronounced dead at the scene.

Parvaiz had originally told police that his family was attacked by a group of three men shouting slurs about "terrorists" but investigators quickly turned their attention to him and Stephen.

Police said Parvaiz and Stephen teamed up to get Noorani out of the picture. Stephen is accused of shooting Noorani four times and then wounding Parvaiz to cover up the crime.

Parvaiz, originally from Brooklyn, is being held on $3 million bail; Stephen, of Billerica, Mass., remains jailed on $5 million bail.
