Luis Melendez Of Kips Bay Arrested Following Death Of 6-Month-Old Nephew

NEW YORK (CBSNewYork/AP) - 6-month-old Alex-Jose Fernandez is dead Thursday morning, allegedly murdered by his uncle.

The baby lived with 33-year-old Luis Melendez at 444 2nd Avenue. Police responded to the apartment following a 911 call regarding an unconscious baby. When they got there, the baby was unresponsive. EMS technicians rushed the child to Beth Israel Hospital, where doctors noticed bruising and swelling on the boy's head.

A CAT scan showed evidence of a brain injury.

Three hours after he arrived at the hospital, Alex-Jose died.

Police say Melendez indicated to investigators that he had shaken the baby.

He faces 2nd degree murder and reckless assault of a child charges.
